Terms and Conditions

These general terms and conditions are applicable to all sales made directly with L’Amarantine, located at 292 traverse de la planète in La Ciotat (13600), with the exception of sales made with online agencies such as booking.com or AirBnb.

The client, therefore, acknowledges having read the present terms and conditions of sale and agrees to respect them.

Entering the required banking information is considered proof of acceptance of these terms and conditions, as well as of the internal regulations of L’Amarantine.

These terms and conditions of sale may be modified at any time. The applicable terms and conditions will be those in force on the date the reservation is made.

As the premises are located in a protected area, specific regulations apply.

 

1. Description of the service provided

L’Amarantine provides a booking service for cabanas on its website.
The information available on this official website prevails over any information published by our partners, including reservation and cancellation policies. As the atmosphere of the cabanas changes frequently, the photos available on this site and on social networks are not contractual.

 

2. Rates
The prices indicated are in euros (€) and include VAT applicable on the date of the reservation.
Any change in the applicable rate, or any modification or introduction of new legal taxes by the competent authorities, will automatically be reflected in the prices indicated on the date of the invoice.

The rates are per room for the number of guests indicated and according to the chosen period. They do not include additional services, which are directly invoiced by the partner at the time of booking.

The rate includes the tourist tax. This tax is fixed by the municipality of La Ciotat.

Some services may be subject to an additional charge and to possible modifications without prior notice, for which L’Amarantine is in no way responsible.

 

3. Reservations and payment methods
Reservations can be made on the website https://amarantine.fr.
The reservation will only be valid if it is paid in full at the time of booking, and after receiving a confirmation.

The stay is agreed to for a fixed time period and is specified in the confirmation.

In the high season, only stays of more than 3 full nights are bookable.

The client can invoke no right of retention.

The establishment reserves the right to refuse any incomplete reservation.

Reservations, regardless of their origin, are payable in euros (€) only.

The establishment accepts the following credit cards: Visa, Mastercard, and American Express, and has a secure payment system.
Additional services will be invoiced directly by the partner on the reservation date.

The client is solely responsible for his choice of services and their suitability to his/her needs. As such, the responsibility of “L’Amarantine” cannot be claimed in this respect.

 

4. Force majeure

Force majeure is considered to be any event external to the parties which is both unforeseeable and insurmountable and which prevents the client from carrying out all or part of the obligations provided for in the contract. This will be the case in particular in the event of a strike of means of transport, hotel staff, government or public riots, or an epidemic.

More extensively, the cases usually recognised by the Court of Cassation case law are considered to be cases of force majeure.

 

5. Cancellations or modifications
Any reservation modification or cancellation request must be made to the establishment by emailing Amarantine@host.smoobu.fr. 

More than 30 days before the date of arrival, the stay will be postponed free of charge depending on availability within 12 months of the date initially planned;

Between 10 and 30 days before the date of arrival, the stay will be postponed according to availability within 12 months of the date initially planned. A fee of 30% of the total amount of the stay will be charged.

Less than 10 days before the arrival date, no modification or refund will be made. 

These cancellation or modification provisions only pertain to standard rates. They do not apply to promotional offers, which cannot be exchanged or canceled, in accordance with the stipulations of article L121-20-4 of the French Consumer Code. 

For reservations with strict cancellation policies, it may be more convenient to change your dates. To do this, simply send a request for a change to your host.

Should there be a price difference, the amount will be indicated before you confirm the request. (In case of force majeure covered by our policy, please specify this during the cancellation process).

If you choose to change or cancel your stay once you are on the premises or if you are refused access to your cabana, no compensation can be claimed.

For bookings made via BOOKING or AIRBNB websites, cancellations must be made via their platforms and according to their own terms and conditions.

 

6. Cancellations made by L’Amaratine
In a force majeure event, as described in section 3 of these terms and conditions, or any other event beyond the control of the establishment, the latter reserves the right to cancel the booking.

The customer will have the option of the reservation being postponed to a later date, within 12 months of the planned date of arrival, or receiving a refund.

In all cases, no other compensation can be claimed.

 

7. Responsibilities and deposit
The establishment “L’Amarantine” declines all responsibility in case of theft, loss of, or damage to the client’s belongings during their stay.

The client will be held responsible for any damage, deterioration or vandalism that may occur to the property or to movable or decorative items on the premises (belonging or not to the establishment) due to the occupation of the premises and/or due to the participants for whom he/she is responsible.

As a result, the establishment “L’Amarantine” may ask the client to leave the grounds without any reimbursement of the stay in progress and to pay for the damage caused by these acts.

A deposit of €1000 will be requested from the client before the beginning of the stay via the Swikly system (secure form, without charging the credit card). 

This deposit will be used in the event of material damage or loss, in addition to the additional costs of repairing the accommodation. 

If the deposit is not paid, the establishment reserves the right to refuse the customer.

 

8. Complaints
Any complaint relating to a stay at L’Amarantine must be sent, within 15 days of the departure from the specific stay, by registered mail with acknowledgment of receipt to the following address:

L’Amarantine, 354 avenue des granières 13600 LA CIOTAT.

After this period, no claim shall be taken into account.

 

9. Insurance
Upon acceptance of the present terms and conditions :
The customer certifies that he/she is covered by civil liability insurance for any accident that may occur during his/her stay at L’Amarantine. 

The establishment certifies that it is covered by professional liability insurance for its course of business.

 

10. Applicable law and dispute resolution
The present terms and conditions are governed by French law.

All disputes to which this contract may give rise, regarding its validity, interpretation, execution, termination, and consequences, shall be submitted to the competent courts under the conditions of ordinary legislation.

 

11. Shooting pro

Any photo shoot or professional filming at L’Amarantine requires written authorization from the owner prior to any commercial use of the photographs. Failure to comply with this rule may result in legal action and financial penalties. 12. Use of the Outdoor Gym

Availability of the Outdoor Gym: L’Amarantine provides its guests with an outdoor gym equipped with fitness equipment for their use during the duration of their stay. Access to this outdoor gym is subject to the conditions outlined below.

Hotel’s Liability: L’Amarantine disclaims any responsibility for accidents, injuries, or damages suffered by guests resulting from the use of the outdoor gym. Guests expressly acknowledge that the use of the gym equipment carries inherent risks, and they utilize these facilities at their own risk.


Warning: Guests are advised that the use of the outdoor gym can be physically demanding and may pose risks to their health and safety. It is highly recommended that guests consult a healthcare professional before using these facilities, especially if they have pre-existing medical conditions or physical limitations.

Use under Guests’ Responsibility: By using the outdoor gym, guests accept that their usage is entirely at their own risk. They declare that they are in good physical condition to use the fitness equipment and commit to exercising caution and common sense during their usage.

Equipment Maintenance: L’Amarantine endeavors to maintain the outdoor gym equipment in good working condition and safe to use. If a guest notices any defective or damaged equipment, they are obliged to immediately inform the hotel staff so that corrective measures can be taken.

Indemnification: Guests agree to indemnify and hold L’Amarantine, its employees, officers, and representatives free from any claims, liabilities, costs, or expenses resulting from their use of the outdoor gym, including bodily injuries, personal injuries, or property damages.

By checking the acceptance box for these present terms and conditions of sale during the reservation or check-in process at the hotel, guests acknowledge having read, understood, and accepted the provisions mentioned above concerning the use of the outdoor gym.
