These conditions are applicable to all sales concluded directly with l’Amarantine sis, 292 traverse de la planète à la Ciotat (13600), with the exception of sales concluded with online agencies such as booking.com or AirBnb.
The customer hereby acknowledges having read these general terms and conditions of sale and undertakes to comply with them.
Entering the required banking information is proof of acceptance of these terms and conditions, as well as of the Amarantine’s internal regulations.
These terms and conditions are subject to change at any time. The conditions applicable will be those in force on the date the reservation is made.
As the plant is located in a protected area, specific regulations apply.
1. Service description
L’Amarantine offers a cabana reservation service on its website.
The information on this official website takes precedence over all information published by our partners, including booking and cancellation policies.
As the atmosphere of the sheds changes frequently, the photos on this site and on social networks are not contractual.
2.price list
Prices are quoted in € euros and include VAT at the time of booking.
Any change in the applicable rate, or any modification or introduction of new legal taxes by the competent authorities, will be automatically reflected in the prices indicated on the date of invoicing.
Rates are per room for the number of people indicated and according to the period selected. Rates do not include additional services, which are billed directly by the partner at the time of booking.
The rate includes the tourist tax. This tax is set by the municipality of La Ciotat.
Certain services may be subject to a supplement and to change without notice, and the establishment accepts no responsibility for such changes.
3. Booking and payment
Reservations can be made at https://amarantine.fr.
Reservations are only valid if paid in full at the time of booking, and after receipt of confirmation.
The stay is agreed for a fixed period and is specified in the confirmation.
In high season, only stays of more than 3 full nights are bookable.
No right of retention may be invoked by the customer.
We reserve the right to refuse incomplete bookings.
Reservations from all sources are payable in euros only.
The establishment accepts the following credit cards: Visa, Mastercard and American Express, and has a secure payment system.
Additional services will be invoiced directly by the partner on the date the service is booked.
The customer is solely responsible for his choice of services and their suitability for his needs, and “l’Amarantine” cannot be held liable in this respect.
4. Force majeure
Force majeure is defined as any unforeseeable and insurmountable event outside the control of the parties, which prevents the customer from fulfilling all or part of its obligations under the contract. This applies in particular to strikes involving means of transport, hotel staff, government or public riots, or epidemics.
More generally, cases of force majeure are those usually recognized by the case law of the Cour de cassation (French Supreme Court).
5. Change or cancellation of stay
Reservation changes or cancellations must be requested by email from Amarantine@host.smoobu.fr.
- More than 30 days before the arrival date, the stay will be postponed free of charge, subject to availability, within 12 months of the original date;
- Between 10 and 30 days before the arrival date, the stay will be rescheduled, subject to availability, within 12 months of the initially scheduled date. A deposit of 30% of the total cost of the stay will be charged.
- Less than 10 days before the arrival date, no changes or refunds will be made.
These cancellation or modification conditions only concern standard rates, or promotional offers, which cannot be exchanged or cancelled, in accordance with the provisions of article L121-20-4 of the French Consumer Code.
For bookings with strict cancellation conditions, it may be more advantageous to change your dates. To do this, simply send your host a change request. In the event of a price difference, the amount will be indicated before you confirm the request. (In cases of force majeure covered by our policy, please report the situation during the cancellation process).
In the event of modification or cancellation of your stay by yourself once on the site, or in the event of refusal of access to your cabanon, no compensation can be claimed.
For bookings made via the BOOKING or AIRBNB websites, cancellations must be made via the platform and in accordance with their own conditions.
6. Modification of stay at the establishment’s initiative
In the event of force majeure, as described in “3.” above, or any other event beyond the establishment’s control, the establishment reserves the right to cancel the stay.
The stay will then be postponed to a later date, at the customer’s discretion, within 12 months of the scheduled arrival date, or reimbursed.
In all cases, no other compensation may be claimed.
7. Liability and security
L’Amarantine” declines all responsibility in the event of theft, loss or damage to guests’ belongings during their stay.
The customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants for whom he/she is responsible, to movable, decorative and immovable property belonging or not belonging to the residence.
As a result, the “l’Amarantine” establishment may ask the customer to leave the establishment without any compensation or refund of the current stay, and to reimburse any damage caused by these acts.
A deposit of 1000 euros will be requested from the customer before the start of the stay via the Swikly system (secure form, no credit card debit).
This deposit will be used in the event of damage to or loss of property, in addition to any extra costs incurred in restoring the accommodation.
If the deposit is not paid, the establishment reserves the right not to accept the customer.
8. Claims
Any complaint relating to a stay must be sent by registered letter with acknowledgement of receipt within 15 days of the departure of the stay which is the subject of the said complaint, to the following address:

After this time, no claim can be taken into account.
9. Insurance
Upon acceptance of these conditions :
The customer certifies that he/she is covered by third-party liability insurance for any claims arising during his/her stay at l’Amarantine.
The establishment certifies that it is covered by professional liability insurance for its activity.
10. Applicable law and dispute resolution
These terms and conditions are governed by French law.
Any and all disputes arising out of or in connection with this contract, whether concerning its validity, interpretation, performance, termination, consequences or consequences thereof, shall be submitted to the competent courts under the conditions of ordinary law.
11. Photo shoots
All professional photo shoots or filming at L’Amarantine require written authorization from the owner prior to any commercial use of the photographs. Failure to comply with this rule may result in legal proceedings and financial penalties (article 544 of the French Civil Code). 12. Use of the outdoor sports hall
Outdoor gym availability: L’Amarantine offers guests an outdoor gym with fitness equipment for their use during their stay. Access to this gym is subject to the conditions set out below.
Hotel liability: L’Amarantine declines all responsibility for any accident, injury or damage suffered by guests as a result of using the outdoor gym. Customers expressly acknowledge that use of the gym’s equipment involves inherent risks, and that they use these facilities at their own risk.
Warning: Customers are warned that using the gym outdoors can be physically demanding and involve health and safety risks. Customers are strongly advised to consult a health professional before using these facilities, especially if they have pre-existing medical conditions or physical limitations.
Use under customer responsibility: By using the outdoor gym, customers accept that their use is entirely under their own responsibility. They declare that they are in good physical condition to use the fitness equipment and undertake to exercise caution and common sense when using it.
Equipment maintenance : L’Amarantine strives to maintain the gym’s equipment in good working order and safety. If a guest notices any faulty or damaged equipment, he/she is required to inform the hotel staff immediately so that corrective action can be taken.
Indemnification: Customers agree to indemnify and hold harmless L’Amarantine, its employees, officers and representatives from and against any and all claims, liabilities, costs or expenses resulting from their use of the outdoor gym, including bodily injury, personal injury or property damage.
By ticking the box accepting these general terms and conditions of sale when booking or registering at L’Amarantine, customers acknowledge that they have read, understood and accepted the above provisions concerning the use of the outdoor gym.
